Welcome to FeCare, a home medical care Website/App/Platform designed to provide top-notch medical services to patients in the comfort of their own homes. These Terms and Conditions applies to all FeCare users, including unregistered visitors and registered users (collectively, “Users”, “you”, or “your”), and to all FeCare services, including our websites (including www.fe-care.com and any of its subdomains, the “Website”), mobile applications (“Mobile Apps”), and related services (collectively, the “Services”). These terms and conditions (the “Terms”) govern your access and use of FeCare website through fe-care.com, mobile application, any of our platforms, and any services offered by FeCare, which include but not limited to nursing, medical escorts, lab tests, vitamin injections, x-rays, online consultation and home specialist visits (the “Services”). The Terms includes all additional policies we provided or may provide in writing. By accessing our Website or App or Platforms or using our Services, you agree to be bound by these Terms. If you do not agree with these Terms, you must not use our Services.

2. Your consent

Please review the Terms and Conditions and each Policy carefully. By accessing and using the Website, App, Platforms you confirm that you have read, understand and accept the Terms and Conditions and the Policies and that you agree to abide by their respective terms each time you access and use the Website/App/Platforms/Our Services. If you do not agree with any of the Terms of Use or any Policy, you may not use the Website/App/Platforms/Our Services.

Registered users of our Website/App/Platform will be required to agree to these Terms and Conditions in order to carry out core services provided by the Website/App/Platform.

3. Modification of Terms

FeCare reserves the right to modify or amend these Terms at any time without prior notice. You are responsible for reviewing these Terms periodically to ensure that you are aware of any changes. FeCare may also, in its sole discretion and at any time, discontinue our Services, or any part thereof, with or without notice. It is your responsibility to review these Terms periodically to ensure that you are aware of any changes. If you do not agree to the modified Terms, you must stop using our Services immediately.

4. Information about us

The Website/App/Platforms and the FeCare Service (defined below) is a Website/App/Platform operated by Bermjly (also referred to as "we," "us", "our" or "FeCare") . We are incorporated in state of Kuwait under Commercial Record 440171.

5. Policies language

All of FeCare's policies are primarily written in the Arabic language, and while we may offer translated versions of these policies, in case of any conflicts between the translated versions and the original Arabic version, the Arabic version shall take precedence and be considered the final and official version.

6. FeCare Service

FeCare service refers to the range of medical services offered by the FeCare Website/App/Platforms, including nursing care, medical escorts, lab tests, vitamin injections, X-rays, and more. The app is designed to provide a convenient way for users to access these services from the comfort of their own homes. In addition to these physical medical services, FeCare also offers online consultations and home specialist visits, which further expands the range of medical care options available to users.

The FeCare service is intended to improve access to quality medical care and help users avoid the inconvenience of having to travel to a hospital or medical clinic. By bringing medical care directly to the user's home, FeCare makes it easier for individuals to receive the medical attention they need, particularly those with mobility or transportation issues.

FeCare works with a network of trusted service providers to deliver these medical services to users. These service providers are carefully selected by FeCare to ensure that they meet the highest standards of quality and safety. FeCare also maintains strict guidelines and protocols to ensure that the services offered through the Website/App/Platforms are safe, effective, and delivered with the utmost professionalism.

7. Use of the App

The FeCare Website/App/Platforms is a powerful tool designed to provide medical services in the comfort of your own home. However, to ensure that the app is used safely and responsibly, there are certain requirements that must be met.

When you download and install the FeCare app, you may be required to register for an account. When you register for an account, you must provide accurate and complete information, including your name, email address, and any other information required by FeCare. You must also choose a username and password, and you are solely responsible for maintaining the confidentiality of your account login information. It is important that this information is accurate and up to date so that our healthcare providers can provide you with the best possible care.
When using the FeCare Website/App/Platforms, you must comply with all applicable laws, rules, and regulations. This includes laws related to data privacy and security, as well as any other relevant laws in the jurisdiction where you are located. In particular, you should be aware of any laws related to the sharing of medical information and data, and ensure that you only share such information in accordance with applicable laws.
You agree to use the FeCare Website/App/Platforms only for lawful purposes and in accordance with these Terms. This means that you must not use the app for any illegal or unauthorized activity, including but not limited to hacking, stealing data, or spreading malware.
You agree to keep your login credentials secure and to protect your account from unauthorized access. You are responsible for all activities that occur under your account, so it is important to take appropriate measures to protect your account.
You agree not to use the account, username, or password of another user at any time or to disclose your password to any third party. If you suspect that your account has been compromised, you should immediately change your password and contact FeCare customer support.

FeCare reserves the right to refuse registration of, or cancel, accounts that it deems inappropriate. FeCare may also, in its sole discretion and without prior notice, suspend or terminate your account and access to our Services, including deleting any content associated with your account.

You may deactivate your account with FeCare at any time, for any reason, by contacting FeCare customer support or by following the instructions in Personal Data Deletion Request page. Deactivating your account will disable your access to all of our Services.

8. Using and Accessing the App, Content, and the FeCare Service

By downloading, installing, or using the FeCare Website/App/Platforms or accessing our Services, you agree to comply with these Terms and Conditions, as well as all applicable laws and regulations. You agree that you will not use our Services for any unlawful purpose or in any way that is prohibited by these Terms.

You agree to use our Services solely for your personal use and not for commercial purposes, unless specifically authorized by FeCare in writing. You also agree not to modify, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products, or services obtained from or through our Services.

FeCare reserves the right to suspend or terminate your access to our Services at any time, for any reason, including if we suspect that you have violated these Terms or engaged in any unlawful or unauthorized activity. We may also modify or discontinue our Services at any time, with or without notice.

You agree that FeCare is not liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses resulting from your use or inability to use our Services or content, even if we have been advised of the possibility of such damages.

When you use FeCare, you are accessing our Services, which include a variety of medical services that are designed to be provided in your home. This includes nursing services, medical escorts, lab tests, vitamin injections, X-rays, and other medical services provided by companies or service providers that we work with. You can also access our virtual consultation and home specialist visits, which are facilitated by us through direct contact with the service provider.

By using FeCare, you acknowledge that you are responsible for your own health and the health of any individuals for whom you are using our Services. You understand that FeCare does not provide medical advice or diagnosis, and that any information or content provided by FeCare or our service providers is for informational purposes only and should not be used as a substitute for professional medical advice or treatment. You also acknowledge that you should always seek the advice of a physician or other qualified healthcare provider with any questions you may have regarding a medical condition.

When using our Services, you must also follow all applicable laws and regulations, including those related to privacy, data protection, and confidentiality. You agree to keep your login credentials confidential and not to share them with any third parties. You agree to immediately notify FeCare of any unauthorized use of your account or any other breach of security.

FeCare may also provide you with access to user-generated content, such as ratings and reviews of service providers. While we encourage you to provide feedback on your experiences with our service providers, we reserve the right to remove or modify any user-generated content that we deem inappropriate or inaccurate.

However, FeCare reserves the right to restrict or terminate your access to our Services at any time, with or without notice, for any reason.

You agree that you will not use our Services for any unlawful purpose or in any way that is prohibited by these Terms and Conditions. You also agree not to use our Services in any way that could damage, disable, overburden, or impair our servers or networks, or interfere with any other party's use and enjoyment of our Services. You may not use our Services to collect, harvest, or transmit any personally identifiable information, including any health information or data, about any other individual without their express consent.

FeCare also reserves the right to remove any content or user-generated material that we deem inappropriate, offensive, or violates our community standards, as well as any content that infringes on the intellectual property rights of others.

Additionally, each of our services may have additional restrictions or requirements that you must comply with in order to use them. For example, if you are using our nursing services, you must provide a safe and clean environment for the nurse to work in, and you must follow any instructions or guidelines provided by the nurse. If you are using our online consultation service, you must provide accurate and complete information about your medical history and current symptoms in order to receive appropriate advice or treatment. If you are using our home specialist visit service, you must be available at the agreed-upon time and location and provide any necessary medical records or information.

You agree to use our Services for personal, non-commercial purposes only, and not to use them in any way that could damage or impair our servers or networks, or interfere with any other party's use of our Services. You also agree to comply with any additional restrictions or requirements for each of our services, and to provide a safe and appropriate environment for any service providers that you work with. 13. Your Interactions with Service Providers

FeCare acts as a facilitator to connect you with service providers who offer various medical services through our platform. However, FeCare is not responsible for any interactions, negotiations, or agreements that you may have with service providers. We do not employ or manage any service providers, nor do we have any control over the services they provide.

You acknowledge and agree that any interactions or agreements you have with service providers are solely between you and the service provider. FeCare does not endorse or guarantee the quality, suitability, or safety of any service providers or their services. It is your responsibility to research and evaluate any service providers you work with, and to take appropriate precautions to ensure your safety and well-being.

You agree to communicate with service providers solely through our platform, and not to exchange any personal contact information, such as email addresses or phone numbers. This is to ensure the privacy and security of both parties and to maintain the integrity of our platform.

FeCare is not liable for any claims, damages, or losses that may arise from your interactions with service providers, including but not limited to any injury, harm, or negligence caused by a service provider's action or inaction. In the event that you have a dispute or disagreement with a service provider, you agree to resolve it directly with the service provider and to release FeCare and its affiliates, officers, directors, employees, and agents from any claims, damages, or demands arising from the dispute.

14. Disputes with Service Providers:

In the event that you have a dispute or disagreement with a service provider, you agree to first attempt to resolve the dispute with the service provider directly. If you are unable to reach a resolution, you may contact FeCare and we will attempt to mediate the dispute.

You acknowledge and agree that FeCare is not responsible for any disputes that may arise between you and a service provider, and that any such disputes are solely between you and the service provider. FeCare is not liable for any claims, damages, or losses that may arise from any disputes between you and a service provider.

If FeCare agrees to mediate the dispute, we will make our best efforts to help you and the service provider come to a mutually agreeable resolution. However, you acknowledge and agree that FeCare is not responsible for the actions or omissions of the service provider, and that any resolution reached between you and the service provider is solely between you and the service provider.

In the event that you are unable to resolve the dispute through mediation, you may pursue any legal remedies available to you. However, you agree to release FeCare and its affiliates, officers, directors, employees, and agents from any claims, damages, or demands arising from any disputes between you and a service provider.

15. Eligibility

To use our Services, you must be at least 18 years old or have the consent of a parent or legal guardian. You must also reside in a location where our Services are available.

16. Payment and Fees

You can make secure and convenient payments for FeCare services directly through the Website/App/Platforms. FeCare takes care of the payment processing, and you can choose from a variety of payment options. By using our services, you agree to pay all fees and charges associated with the services you receive, and you authorize FeCare to charge your payment method for these fees.

The fees for our Services are set by the service providers or companies we collaborate with. FeCare is not responsible for setting or changing the fees. You agree to pay the fees for the Services you request in accordance with the terms and conditions of the service provider.

17. Appointments

You may schedule appointments for the Services through our Website/App/Platforms. You must provide accurate information when scheduling appointments. You must also be available at the scheduled time and place for the Service. If you cancel an appointment, you may be subject to a partial or full refund, please refer to our refund policy.

You understand and agree that FeCare has the right to review and remove any content that violates these Terms, is inappropriate, or is otherwise objectionable. FeCare is not responsible for any content submitted by you or any other user of our Services.

You grant FeCare a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display any content you submit or post through our Services, in whole or in part, and in any form, media, or technology now known or later developed.

You agree to indemnify and hold FeCare and its affiliates, officers, agents, and employees harmless from any claim, demand, or damages, including reasonable attorneys' fees, asserted by any third party due to or arising out of your use of our Services or the content you submit or post through our Services.

21. Banner Advertising

FeCare may display banner advertisements within the Website/App/Platforms. These advertisements may be provided by third-party companies or partners, or may be created in-house by FeCare. These advertisers may collect data such as IP addresses, browser type and version, time and date of interaction, and other information. By using the FeCare service, users consent to the use of banner advertising and the collection of data by third-party advertisers. The information provided on the FeCare platform is for informational purposes only and is not intended to be a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of a qualified healthcare provider with any questions you may have regarding a medical condition.

FeCare makes no guarantee that the platform or its services will be available at all times, or that any service provider will be available to provide services at any particular time.

FeCare makes no guarantee that using the platform or its services will result in any particular outcome or benefit.

FeCare is not liable for any damages, whether direct, indirect, incidental, special, or consequential, arising out of or in connection with the use of our services, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses. FeCare's liability for any claim arising out of or in connection with the use of our services is limited to the amount paid by you for the service in question.

23. Intellectual Property

All content on the FeCare platform, including text, graphics, logos, and images, is the property of FeCare or its licensors and is protected by copyright, trademark, and other intellectual property laws.

24. Termination

FeCare may terminate your access to our Services at any time for any reason, including if you violate these Terms. You may also terminate your access to our Services by uninstalling the Website/App/Platforms from your device.

25. Fair Usage Policy

FeCare reserves the right to enforce a Fair Usage Policy to ensure that all users are able to access and use the FeCare service fairly and equally. This policy is in place to prevent any abuse or misuse of the service that could negatively impact the user experience for other users or cause excessive strain on the service providers.

The Fair Usage Policy may limit the frequency, volume, or duration of use of certain features or services of the Website/App/Platforms, if such usage is deemed excessive or unreasonable by FeCare. Examples of excessive or unreasonable usage include, but are not limited to, scheduling multiple appointments within a short period of time, repeatedly canceling appointments without proper notice, or engaging in abusive or inappropriate behavior towards service providers.

If FeCare determines that a user's usage of the FeCare service violates the Fair Usage Policy, FeCare may take any necessary actions, including but not limited to, warning the user, suspending or terminating the user's account, limiting access to certain features or services of the Website/App/Platforms, or any other action deemed appropriate by FeCare.

The Fair Usage Policy is not intended to limit a user's access to the FeCare service, but rather to ensure that all users are able to access and use the service fairly and equally. Users are encouraged to review the Fair Usage Policy periodically to ensure compliance with the current policy.

FeCare reserves the right to modify or amend the Fair Usage Policy at any time, and such modifications or amendments will be effective immediately upon posting on the Website/App/Platforms. It is the user's responsibility to review the policy periodically to ensure that they are aware of any changes.

26. Consequences for failure to comply with the User Agreement

Users who fail to comply with the terms and conditions of this User Agreement may face consequences, including but not limited to, suspension or termination of their account, loss of access to FeCare services, or legal action.

FeCare reserves the right to investigate and take any appropriate legal action against any user who violates this User Agreement. This includes, but is not limited to, removing any content or information posted by the user, terminating the user's account, and reporting any illegal or unauthorized activity to law enforcement authorities.

In addition to the above consequences, users who violate this User Agreement may also be responsible for any damages, losses, or expenses incurred by FeCare or any third parties as a result of their non-compliance.

Users are responsible for their use of the FeCare service and for ensuring compliance with this User Agreement, as well as all applicable laws and regulations.

27. Indemnification

You agree to indemnify and hold FeCare and its officers, directors, employees, agents, and affiliates harmless from any and all claims, damages, liabilities, costs, and expenses, including reasonable attorneys' fees, arising out of your use of our services or your breach of these terms and conditions.

28. Governing law and jurisdiction

These terms and conditions are governed by and construed in accordance with the laws of Kuwait. Any disputes arising out of or in connection with these terms and conditions will be subject to the exclusive jurisdiction of the courts of Kuwait.

29. Dispute Resolution

Any dispute or claim arising out of or relating to these Terms and Conditions, the FeCare platform, or its services, shall be resolved through binding arbitration in accordance with the rules of the International Chamber of Commerce's Kuwait.

The decision of the arbitrator shall be final and binding on all parties, and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.

You agree that any dispute or claim against FeCare must be resolved in accordance with this dispute resolution clause. You also agree that any dispute or claim against a service provider must be resolved directly with the service provider and that FeCare is not responsible for any such disputes or claims.

30. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

31. Headings

Headings used in the Terms are provided for convenience only and will not be used to construe meaning or intent.

32. Assignment and Entire Agreement

We may assign or subcontract any or all of our rights and obligations under the User Agreement with you to a third party at any time, at our discretion. You may not, without our prior written consent, assign or dispose of any of your rights or obligations arising under the User Agreement.

A failure to exercise or delay in exercising a right or remedy provided by the User Agreement or by law does not constitute a waiver of the right or remedy or a waiver of other rights or remedies. No single or partial exercise of a right or remedy provided by the User Agreement or by law prevents further exercise of that right or remedy or the exercise of another right or remedy. The rights and remedies contained in the User Agreement are cumulative and not exclusive of rights or remedies provided by law.

By agreeing to the User Agreement you are also agreeing to the transfer of, by way of novation, all respective rights and obligations outlined in this document.

The Terms of Use and the Policies contains the entire agreement and understanding between the parties relating to the Website/App/Platform and the FeCare Service, and supersedes any and all prior agreements, arrangements, statements and understandings, except for any fraud or fraudulent representation by either you or us. In the event of any inconsistency between any Policy and the Terms of Use, then the Terms Use shall take priority.

33. Contact from Us

In the course of providing you services and in respect of your use of the Website/App/Platform, we may need to communicate with you via email or the other details that you have submitted to us. You agree to receive emails which are specific to your order and necessary for the normal functioning of the Website/App/Platform, including emails which help inform users about functionality of the Website/App/Platform.

34. Feedback

You have no obligation to provide us with ideas, suggestions, proposals, or bug or crash reports (“Feedback”). If you submit Feedback to us however, then you grant us a non-exclusive, irrevocable, perpetual, worldwide, royalty-free, sub-licensable, and transferable license to make, use, sell, have made, offer to sell, import, export, reproduce, publicly display, distribute, modify, and publicly perform the Feedback.

Your use of the Website/App/Platform and the FeCare Services is subject to compliance with the following policies which provide additional terms and conditions related to specific services and features related to the Website/App/Platforms:
